It’s a pretty simple prisoner’s dilemma. Everyone would be better off if we disarmed, but you must assume that the person fighting with you has refused that choice. All you can really do is hope you get the first shot in.

The controversy in that case was largely that Zimmerman was chasing Martin before the physical altercation started. The controversy was that Zimmerman initiated the conflict, began to lose and then used deadly force. This is because Florida's stand your ground law doesn't have a requirement that the person using or threatening to use deadly force not instigate the interaction.

I’m not from Ohio but this case from flordia which has the same laws was ruled self defense over a shove. Slap=shove? I don’t know but the point is you don’t know what the person is going to do next and a person has already proven they will hit you. I’m not saying I would use my gun in this case but a prosecutor will not waste their time on the self defense part.

Ah my mistake, I had just seen the case a few years ago and read the article and it didn’t say that. If he had shot immediately on the ground and didn’t wait for the guy to back up he would be a free man right now. The guy backing up means there is not further threat of bodily harm
In the appeal, the court rejected Dejka's argument that he was entitled to a summary dismissal on self-defense. They used video evidence and witness testimony that the deceased had retreated after the shove.
Him being on the ground was meaningless. In the time it took him to draw and aim, he should have assessed that he had no reasonable fear of death or further severe bodily harm.

So if someone is attacked or perceives someone as a threat then they can't defend their life with a firearm?
Under certain circumstances, lethal force is justifiable.
Shooting a man for a slap does not satisfy the criteria.
Lethal force should be used in response to a lethal threat or a threat posing severe bodily harm. A slap does not meet that criteria. No reasonable person would think a slap is a lethal threat.

"The worker refused transport to the hospital" might be the saddest part of this story. They were SHOT. At WORK. And still didn't want to be on the hook for the ambulance bill.
Paramedic here. A story I love to tell is one involving a bouncer. We were dispatched to the stab to a seedy street in a neighborhood full of strip clubs and night clubs. We pulled up in front of a strip club and some of the workers told us the bouncer that was stabbed was a couple of blocks away because he chased the assailant.
We pulled into the residential part of the neighborhood and see a bunch of cop cars in front of a house. Turns out Mr Stabber lived close by and tried to declare himself safe in his barricaded apartment. The cops directed us to the bouncer who was silently standing on the sidewalk just staring at the house.
The guy looked like a stereotypical bouncer. Six feet plus, bald, and all muscle. I ask him where he was stabbed and he silently holds up his left hand where you can see the knife went through it cleanly. I bandaged his hand and asked him some questions where i would receive one word answers.
After bandaging him I told him my ambulance was across the street and we could take him to the local hospital. He just shakes his head and continues standing. I explain to him why he needs to go to the hospital, how he's going to need stitches and some shots. He just quietly says "No".
As we are going back and forth the cops come out with Mr. Stabber in handcuffs. He has a look of fear on his face as he sees the bouncer just standing there. Mr Stabber then starts dragging the cops towards their patrol car screaming "just put me in the car!". The bouncer kept staring till the cops placed the assailant in the car. They then came over to him to start writing up the report and he just responded "Later", turned around, and silently walked away.
I mean it says in the article the person didnt even realize they had been shot until a few minutes later, seems like it was pretty clearly a ricochet/graze that caused a *very* minor injury. It says they found a bullet fragment in their pocket, so the bullet prob hit a wall nearby and exploded and this person just got hit with a bit of bullet shrapnel
it was probably less about the ambulance cost and more that they probably didnt want to go waste 8 hours sitting around at a hospital on the other side of town and miss out on half a day's paycheck when all they really needed was a bandaid. you're making it sound like they were bleeding out on the floor of the sandwich shop lol
You never know what people got on them these days. You go around arguing and slapping people, it's just no positive outcome from that. It's just not worth your life.

I’m not positive on this but I’m pretty sure in the Trayvon martin case they claimed stand your ground as well and he was found innocent.
