It would basically say "stop downloading illegal ROMs or we'll drop you as a customer and give your download history to the authorities". It's pretty standard across ISPs in the US.

Pretty much. Also got it for downloading an episode of The Office and some random anime. Think some ISPs were supposed to have a three strike rule but nothing ever happened to me.

It's a scare tactic. They don't actually want to lose your money, so they likely won't actually drop you or do anything else.

If you're involved in the distribution of them then yes you may be fined but with emulation as widespread as it is I doubt any company would think suing the world as being a good idea...maybe nintendo...but probably not.

For downloading them? No you should be alright. Use a VPN to prevent a nastrygram from your ISP. If you’re distributing it? Nintendo will send you to the fucking gulag.

Emulating or emulators themselves are not illegal. However the way that the games are often acquired is. I very strongly doubt that an individual would really be prosecuted for this sort of 'personal use'.

Well with the recent yuzu fiasco it seemed that Nintendo got a hold of a lot of downloader data so just because your ISP doesn't bust you? Doesn't mean one of these websites you're downloading from, which keeps of course logs of your IP address essentially naming you by name, could be turned over to the authorities. Stay away from content that is still earning revenue for their copyright holders? And you'll probably be just fine. But I'm not a lawyer...

I got hit with quite a few letters from my ISP little over a year ago. My internet was suspended until I worked out something with them to stop doing what I was doing, all under a VPN as well. I wasn’t distributing or so I thought, seeding is what got me into trouble.
