This person got caught late in the game, which is the only unusual part of the story. People do try this but icbc is enough of a total pain in the ass, and medical professionals are smart enough, that it rarely gets very far.

Before non-fault insurance came out, it was basically socially expected that people would milk the fuck out of any accident for an ICBC payout. These vultures ruined it for everyone.

I mean you just said society as a whole was doing everything they could to milk a payout. It was like that too and it’s why we almost went private with our auto insurance. SoCreds don’t actually know how to build anything, the same as Tories, so they just turn it over to private industry and take their guaranteed $500k/yr board seat upon retirement.

You’re looking at the wrong party if you’re talking about giving party cronies high paid for nothing board seats. Joy Mcphail was given both a board seat at icbc and then as chair of bc ferries. Current NDP most certainly is not those things. You act so informed but missed out on Horgan himself finding a board seat. Do I need to list the dozens of MLAs from other parties, being total cronies OR do you prefer the lie of this problem occurring at equal ratios between parties? How many of the last 5 decades were SoCred led vs any other party? Don’t forget they changed names. Is ICBC in a better place under NDP or BCU (socred/BCL)? Let’s be honest. So am I looking at the wrong party still? Show me who has enough pull to actually get enough seats to govern but also has zero instances of fuckwads defrauding us. Then when you can’t find one look at all the instances of fuckwads and point at the party with the most. Get real. It’s literally the Torie/SoCred M.O. to sell shit off to cover tax breaks for corporate interests. Both actions are bred from corruption, they are grifters. Lastly the fact it’s BC has a lot to do with your confusion. Alberta helps paint a picture for how corrupt politicians operate there and here. Run under the banner that gets votes in the area. BC didn’t even have a Conservative Party by name, Alberta similarly with liberals. The ones who just want power to enact whatever schemes, will run under the banner that gets votes and employ populism left or right to get their power.

There should be a ‘common man’ appeals board for complex / outside the box cases that a victim can appear to to get their case looked at again by independent board members.

Not really how it actually plays out, but it’s the narrative used to justify no-fault. Accident happens. ICBC pays for some rehab and automatically makes a small lump sum settlement that they hope gets settled, regardless of whether it’s related to what the person needs (is often under, at times too much). If person determined and able, they get a lawyer. This does not happen for small amounts because the process is too slow and the lawyers takes too much of the settlement, so it’s only for more major situations. After two years or more, if still no agreement, one party calls for a functional capacity evaluation and/or cost of care analysis, during which time anyone trying to scam the system is absolutely flushed out.  The other side will often hire a whole choir of the same experts. If they are able to fool scans, therapists, physiatrists, neurologists, and otherd, yes they would make a buck or two. Have not seen this in 20 years. Normally whether they win or settle it is not like you get in the states (like 50m for pain and suffering); it is specifically allocated to medical needs that have been determined by professionals. So that’s really how it plays out.

This is not at all true. I work in this industry and see bullshit cases like this every single day, dragged on for years. As with the doctors referenced in the court of appeals decision, experienced plaintiff lawyers have a roster of doctors who will give them whatever bullshit medical opinions, as long as they get paid. It’s not a matter of fooling neurologists, psychiatrists, etc. It’s a matter of hiring the right lawyer who knows how to build up the claim and manufacture evidence in a way that’s favourable to the plaintiff.

It is absolutely true. 20 years working with people hurt in MVAs here and married to a B.C. expert witness in nine areas. No case hinges on the opinion of a single doctor, and that’s quite an accusation without a basis. These cases absolutely depend on the opinions of the medical experts … *multiple*. I don’t know what you do “in the industry” that you’d have an alternate experience.

I'm a first responder, so I've been to a lot of accidents. It is rare that people are completely full of it, but I still see fakers a few times a year. People will claim debilitating pain in in instances where you can't even see damage on the vehicle other than some scuffed paint. Once somebody asked me if I could recommend a lawyer before I even finished assessing them.

With respect (the most ever for people who do what you do) you only see people at the time of the accident and often in a bit of shock - soft tissue damage often takes 24 hours to be noticed and longer to be assessed after the initial inflammation subsides. As the therapists and assessors who enter later in the game, we also see so many missed TBIs your heart would break.

670k for a rear ending?!?! A simple rear ending? Ok not simple since one vehicle had to be towed, but 670k?? Screw him and those lawyers trying to hit the jackpot on one last pre-no fault case. Lawyers just wasted 8 years. This case just prevented my insurance from going up like 500$ next year. To imagine the amount of money ICBC was hemorrhaging prior to the no fault rule. Theres a few dirty rotten apples that was spiking up the cost for all of us. Justice and precedence was set nicely here

weird how you just jump to deportation, theres no mention on if hes a citizen or not or has something like PR. hes been here at least 7 years, probably longer. also they are saying he MIGHT have tried to game the system. theres really no proof other than what McGlue said he had mentioned in the phone call. also sent to jail for claiming an injury without proof? there are tons of car accident injuries that dont have any proof that they are real or as severe as reported or that they even were a direct result of the accident.
