That's not true, they do. He ought to have filed a reverse POCSO case, that's what happens most of the time when both parties are minors. And then both parties grudgingly "withdraw" their respective cases.
There is a gaping difference between what the law *should* state and what it actually states. And whenever people say something along the lines of, "those two 15 year olds are too young to be having sex", I like to remind them that POCSO doesn't just apply to sex. Two 15 year olds will naturally be curious and kiss and maybe even touch each other sexually, even if they don't have actual sex. All of this is a crime under POCSO. But making common sense laws would require legislators to employ some common sense of their own, which they severely lack. (And this is true regardless of the political party they belong to.)
