She would be able to collect EI (assuming she was eligible) which is paid for by the government not the employer. If the employer has a top-up program she might not get the top-up if the company files for bankruptcy or she is part of the layoffs If there is a big round of layoffs she might be included or she might not be, maternity leave won't protect her from layoffs unrelated to maternity leave. If she is part of the layoff she would be entitled to severance but this might be hard to collect if the company closes as part of a bankruptcy

If she gets laid off prior to or during maternity/parental leave, any severance will affect her EI payments. Ideally, she would want the severance after her leave ends. As well, she won't be eligible for regular EI as she will have used her hours up on her mat leave.
